Terms & Conditions
By purchasing a pass (including a complimentary guest pass) or membership to The Wonder, the customer acknowledges that they have carefully read this agreement and understand all of its terms, policies and procedures, releases, waivers and indemnification of the facility. The customer agrees to assume all risks of bringing their child to The Wonder and that in the event of the child’s illness or injury, the customer has no recourse against The Wonder, its employees, agents and officers.
WAIVER, RELEASE & INDEMNITY
Risk of Illness or Injury. The customer is aware of the risk of illness or injury inherent in any program. The the customer and his/her child is participating in The Wonder’s programs upon the express understanding that the the customer hereby indemnify, waive, and release The Wonder, its employees, agents and officers from any and all claims, liabilities, expenses or judgments, including attorneys’ fees and court costs (hereinafter “Claims”) resulting from any of the following: (a) the the customer’s or child’s participation in a program or any illness or injury resulting there from; (b) exposure of the the customer or the the customer’s child to any illness or disease while on The Wonder’s premises; or (c) any injury or damage to the person or property of the the customer or the the customer’s child while on The Wonder’s premises.
The customer further represents that neither they, nor their child, will be ill when coming to The Wonder and the child will not, to the best of the customer’s knowledge, have been exposed to any contagious disease.
The Customer’s Responsibilities. The customer assumes full responsibility for himself/herself, as well as the customer’s children, authorized caregiver, and invited guests. The customer shall indemnify The Wonder, its employees, agents and officers against any and all liability incurred by any act of the customer, child or authorized caregiver. The customer agrees that he/she or their authorized caregiver shall remain on the The Wonder premises at all times while their child is on the premises, unless otherwise agreed to by The Wonder, and the customer agrees to assume all risks that may occur should the customer or authorized caregiver leave the premises.
Photo Release. The customer grants The Wonder permission to use their likeness and the likeness of their children visiting the The Wonder premises in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration. The customer understands and agrees that all photos will become the property of The Wonder. The customer irrevocably authorizes The Wonder and its affiliates and representatives to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose including but not limited to news, web casts, promotional purposes, telecasts, advertising, and social media. In addition, the customer waives any right to inspect or approve the finished product wherein the likeness appears. Additionally, the customer waives any right to royalties or other compensation arising or related to the use of the photo. the customer holds harmless, release, and forever discharge The Wonder from all claims, demands, and causes of action which the customer, his/her heirs, representatives, executors, administrators, or any other persons acting on his/her behalf or on behalf of his/her estate have or may have by reason of this authorization.
RULES & REGULATIONS AT The Wonder
The following rules and regulations apply to all The Wonder facilities and may be amended at the discretion of The Wonder management. On all questions regarding the interpretation of rules and regulations, the decision of The Wonder shall be final. The Wonder reserves the right to suspend visitor privileges for violation of any rule or regulation.
Indoor Play Space Policies. The Wonder’s indoor play space is offered throughout the day for children aged 0-10 years old. Children using the indoor play space must be accompanied by their parent/legal guardian or authorized caregiver at all times. For your child’s safety, no outside food, drinks or shoes are permitted in the play area. Shoes of any kind are prohibited in the classrooms and the indoor play space. We request that all the customers wear socks to the facility. Occupancy in the play space is limited to what is deemed acceptable by the Fire Marshall and reasonable by the management of The Wonder. The Wonder reserves the right to limit the number of children/caregivers that are in any enclosed area, including the indoor play space, at any one time. the customers acknowledge that such effort is made in order to provide a safe and fun environment with limited inconvenience.
The Wonder Staff. The Wonder’s staff is part of our community who are highly trained and here to take care of you while you are working and socializing in our spaces. Inappropriate conduct with any staff member will lead to the immediate termination of your membership and/or reservation, with no refund to you. YOU ACKNOWLEDGE AND AGREE THAT THE WONDER’S STAFF IS NOT RESPONSIBLE FOR YOUR CHILD OR YOUR CHILD’S BEHAVIOR AT ANY TIME, AND YOU WILL BE SOLELY RESPONSIBLE FOR THE SAFETY AND BEHAVIOR OF YOUR CHILD AT ALL TIMES. FOR THE AVOIDANCE OF DOUBT, THE WONDER’S STAFF WILL NOT CHANGE DIAPERS, FEED OR PROVIDE SIMILAR SERVICES FOR YOUR CHILD.
Check-In Procedures. The customers will be required to check in with front desk staff upon entering a The Wonder location. Please note that we do not accept cash onsite.
Stroller Policies. Due to fire safety regulations, no strollers are allowed inside The Wonder premises or beyond designated stroller areas.
Parent/Legal Guardian or Authorized Caregiver Presence. At least one parent/legal guardian or authorized caregiver per family must remain on the premises at all times while a child is at The Wonder.
Personal Conduct. All the customers, their children, and their caretakers shall conduct themselves in ways that do not threaten the health, well-being, and full enjoyment of The Wonder’s offerings by other customers, their children and caretakers. The Wonder reserves the right to remove any customer from the premises for conduct that is judged to be detrimental to the welfare of other customers. This includes the right to refuse a child’s participation in any class, program or service due to the child’s continued behavioral problems.
Illness Policy. In consideration of our other members, please keep sick children at home. Children should not return to The Wonder after illness, until symptoms have been absent for at least 24 hours. Please refer to the CDC’s website for specific information regarding contagious illnesses, or ask for more information at the front desk. The Wonder reserves the right to send a child home to get well. If your child has allergies, please inform a The Wonder staff member and request to include this information on your online account. The Wonder does not have a medical staff available and is not permitted to provide emergency or other medical treatment.
Animals and Items from Home. To help provide a safe environment, live animals other than service animals are not permitted on The Wonder premises. Children are not allowed to bring objects that may be a safety hazard, such as toys, jewelry, food or anything that may present a choking or strangulation hazard. Transitional objects such as blankets, stuffed animals or pacifiers are welcome.
Personal Belongings. The Wonder accepts no liability for loss or damage to any personal property brought onto The Wonder premises. This includes, but is not limited to, any property left on the premises. Any personal property left on the premises and handed in to a The Wonder staff member will be retained for thirty (30) days. After this time, the property will be donated or disposed of.
Cell Phones. Please do not allow the use of cell phones to detract from your ability to supervise your child. The Wonder requests that ringers be turned to silent or vibrating mode during your visit. Please speak in a low voice when using your cell phone.
Cancellation policy. Customers may cancel or reschedule reservations up to 24 hrs before the start of their reservation. Cancellations made within 24 hrs of the reservation time will be treated as a no-show. Refunds or credits will not be issued for no-shows. Memberships may be cancelled anytime.
No Smoking. Smoking is strictly prohibited at The Wonder.
Photography. You may not photograph or use the images of any other customer whether on social media or for any other purpose, without their express consent. The Wonder shall not be liable to you or any other person for any photos or images taken by or of you or any member of your family.
Alterations to Rules & Regulations. The Wonder reserves the right to make changes to these rules and regulations at any time.
Disclaimer of Liability. The Wonder is not liable for any harm or loss to persons or property. Any protection exercised or offered by The Wonder shall be deemed purely gratuitous on its part and shall in no way be construed to make it liable for any loss or inconvenience suffered by the customer. The Wonder is not responsible in any circumstances for indirect, consequential or punitive damages.
